Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and RealCo LLC (“RealCo,” “we,” “our,” or “us”), a Florida limited liability company. By accessing or using our platform at realco.io (“Platform”), you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

2. Description of Services

RealCo is an online marketplace that connects property owners (“Hosts”) with traveling professionals, including travel nurses, healthcare workers, and business travelers (“Travelers”). RealCo provides the technology platform to facilitate these connections but is not a party to any rental agreement between Hosts and Travelers.

RealCo does not own, manage, or control any properties listed on the Platform. We are not a real estate broker, property manager, or landlord. Any rental agreement is solely between the Host and the Traveler.

3. User Accounts

To use certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activity that occurs under your account

You must be at least 18 years of age to create an account. By creating an account, you represent that you are 18 years of age or older.

4. Host Terms

If you use RealCo as a Host, you additionally agree to:

  • Complete RealCo's identity verification process before your listing goes live
  • Provide accurate and truthful information about your property, including photos, amenities, pricing, and availability
  • Comply with all applicable local, state, and federal laws regarding rental properties, including landlord-tenant laws, zoning regulations, and tax obligations
  • Maintain your property in a safe, clean, and habitable condition
  • Honor all commitments made to Travelers through the Platform
  • Not discriminate against any Traveler based on race, color, religion, national origin, sex, disability, familial status, or any other protected characteristic

Subscription and Fees

Host access to the Platform requires a paid subscription. Current pricing is available at realco.io/pricing. Subscriptions are billed annually or monthly at your election. You may pause your subscription at any time; paused accounts remain visible on the Platform but Travelers will be unable to message you until your subscription is reactivated. RealCo reserves the right to change pricing with 30 days' notice.

Verification

RealCo offers optional and required verification services. Identity verification is required for all Hosts. Property verification and background checks may be required or offered as optional upgrades. Verification badges indicate only that RealCo has completed the specific verification process described — they do not constitute an endorsement, guarantee, or warranty of any Host's character, conduct, or property condition.

5. Traveler Terms

If you use RealCo as a Traveler, you additionally agree to:

  • Provide accurate information about yourself, your profession, and your intended stay
  • Complete any verification process required by RealCo
  • Treat Host properties with care and respect
  • Honor all commitments made to Hosts through the Platform
  • Conduct your own due diligence before entering into any rental agreement
  • Never send money or personal financial information outside of the Platform's designated payment channels

6. Verification Disclaimer

IMPORTANT — PLEASE READ CAREFULLY

RealCo's verification process is designed to help create a safer marketplace, but it has limitations. Verification badges indicate only that a specific verification step was completed at a specific point in time. RealCo makes no representations or warranties regarding the accuracy of verified information, the character or conduct of any user, the condition or safety of any property, or the suitability of any rental arrangement.

Travelers are strongly encouraged to exercise independent judgment, conduct their own research, request video walkthroughs, speak directly with Hosts before committing to any rental, and never transfer funds outside of secure, designated channels.

RealCo is not responsible for the conduct of any user or the condition of any property listed on the Platform.

7. Prohibited Conduct

You agree not to:

  • Post false, misleading, or fraudulent listings or information
  • Harass, threaten, or intimidate any other user
  • Use the Platform for any unlawful purpose
  • Attempt to circumvent the Platform by conducting transactions outside of RealCo
  • Scrape, copy, or distribute any content from the Platform without permission
  • Impersonate any person or entity
  • Upload viruses, malware, or any other harmful code
  • Use the Platform to discriminate against any protected class
  • Solicit personal financial information from other users

8. Intellectual Property

The Platform and all content, features, and functionality are owned by RealCo LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our express written consent.

By posting content on the Platform (including property photos, descriptions, and profile information), you grant RealCo a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content for the purpose of operating and promoting the Platform.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. REALCO DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, REALCO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, ANY RENTAL AGREEMENT BETWEEN A HOST AND TRAVELER, OR ANY CONDUCT OF ANY USER, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF REALCO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL REALCO'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO REALCO IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless RealCo LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, your violation of any third-party rights, or any dispute between you and another user of the Platform.

12. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court.

Class Action Waiver: You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exception: Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

Arbitration shall take place in Miami-Dade County, Florida, unless otherwise agreed. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. To the extent any dispute is not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.

14. Termination

RealCo reserves the right to suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

15. Changes to Terms

RealCo reserves the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the updated Terms.
